Terms & Conditions
Last updated: 27 June 2026 · Version 1.0
These Terms govern your use of ateliergabuu.com (the “Site”) and any purchase or service contract you enter into with Atelier Gabuu. They are written in plain English. By placing an order or booking a consultation, you accept these Terms in full.
1. About Us
Atelier Gabuu, [[Legal entity name TBD]]
[[Registered address, Copenhagen, Denmark]]
CVR: [[TBD]] · VAT: [[TBD]]
Email: contact@ateliergabuu.com
We design and hand-craft premium leather footwear in Copenhagen. We sell directly through this Site to consumers worldwide.
2. Our Services
We offer three distinct services:
- Ready-to-wear: shoes from our published catalog, made on a standard last, shipped from stock or made-to-order against your selected size, leather and finish.
- Made-to-Order: a catalog design configured to your specifications (leather, colour, sole, lining, lacing) and built on a standard last in your size.
- Bespoke: shoes designed and built from scratch around a personal last carved to your foot, following one or more in-person fittings in Copenhagen or via our Remote Bespoke kit.
3. Prices & Taxes
Prices are quoted on request and confirmed in writing before any order is placed. All quotes are given in Euro (€) and include applicable Danish VAT (currently 25%) for orders shipped within the European Union. Orders shipped outside the EU are invoiced VAT-exclusive; you are responsible for any customs duties or import taxes levied by the destination country. Shipping costs are included in the written quote. We reserve the right to correct obvious pricing errors before accepting an order.
4. Ordering & Contract Formation
When you submit an order, you make an offer to buy. The contract is formed only once we send you a written order confirmation by email. An automated “order received” message is not yet a confirmation. We may decline an order at our discretion, for example if a product is unavailable, the pricing was clearly wrong, or we cannot verify payment, and in that case any payment is refunded in full.
5. Payment
Payments are processed by Stripe Payments Europe, Ltd., an authorised payment institution. We accept major debit and credit cards. For bespoke commissions, a non-refundable deposit (typically 40% of the total) is taken on confirmation; the balance falls due before final delivery. We do not store your card details.
6. Delivery
Ready-to-wear orders ship from Copenhagen within 5 working days of order confirmation. Made-to-Order lead time is typically 12–16 weeks; Bespoke is 8–12 months. International shipments may be subject to customs clearance delays beyond our control. Risk of loss passes to you upon delivery to the address you provided.
7. Right of Withdrawal (14-Day Cooling-Off)
If you are a consumer (i.e. buying for purposes outside your trade or profession) and live in the European Union, you have the right to withdraw from a ready-to-wear purchase within 14 days of receiving the goods, without giving any reason, under the EU Consumer Rights Directive 2011/83/EU and Danish Consumer Contracts Act (Forbrugeraftaleloven).
How to exercise it: send a clear statement of withdrawal, by email to contact@ateliergabuu.com or using the model withdrawal form below, within 14 days of delivery. You then have another 14 days to return the goods at your own cost. Returned shoes must be unworn (sole untouched), in their original packaging, with all accessories.
We refund the price of the goods plus the standard delivery cost within 14 days of receiving the returned goods (or proof of return), using the same payment method you used for the original transaction. If you choose a more expensive delivery option than our standard, we refund only the standard portion. We may reduce the refund to reflect any diminished value resulting from handling beyond what is necessary to inspect the goods.
Important exception, bespoke and made-to-order goods:
Under Article 16(c) of Directive 2011/83/EU, the right of withdrawal does NOT apply to goods made to the consumer’s specifications or clearly personalised. This covers every Made-to-Order and Bespoke commission we accept, because each pair is built to your individually chosen leather, colour, sole, and (for Bespoke) your personal last. By confirming such an order you waive the right of withdrawal as permitted by law.
8. Conformity & Defects (Legal Guarantee)
All goods sold to consumers in the EU benefit from the statutory two-year guarantee of conformity under Directive (EU) 2019/771 and Danish law (Købeloven). If a shoe is faulty or does not match its description on delivery, contact us and we will repair, replace or refund free of charge as required by law. This guarantee is in addition to, and does not affect, your right of withdrawal under section 7.
Normal wear, sole wear, leather creasing, edge dressing fade, is not a defect. We offer a paid resole and refurbishment service for the lifetime of every pair we make.
9. Bespoke & Made-to-Order Specifics
Bespoke orders proceed in stages: consultation, last-making, trial fitting, final delivery. Once a stage is approved by you in writing it cannot be unwound. Substantial design changes after the last has been carved may incur additional cost. We will always quote in writing before doing the extra work.
10. Intellectual Property
All content on the Site, photographs, copy, designs, last shapes, 3D models is owned by Atelier Gabuu or licensed to us. You may view and share links to it for personal, non-commercial purposes. Any other use requires our written permission.
11. Complaints & Dispute Resolution
We try to resolve every issue within 30 days. Email contact@ateliergabuu.com with a clear description and your order number.
If we cannot reach agreement, EU consumers may use the European Commission’s Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Danish consumers may also file with the Danish Consumer Complaints Board (Forbrugerklagenævnet) at kpo.naevneneshus.dk.
12. Liability
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited by Danish or EU law. Subject to that, our total liability arising from or in connection with a contract is capped at the price you paid for the goods or services in question.
13. Governing Law & Jurisdiction
These Terms and any contract formed under them are governed by Danish law, without prejudice to the mandatory consumer protection rules of the country in which you habitually reside. Disputes will be heard by the competent Danish courts; consumers retain the right to bring proceedings in the courts of their place of residence under Regulation (EU) 1215/2012.
14. Changes to These Terms
We may update these Terms to reflect changes in our services or the law. Updates apply only to orders placed after the new version takes effect. The version that applied to your order is the one published at the time you placed it.
